These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Ada Jenkins Family Center.
REQUEST FOR RELEASE OF FUNDS
On March 5, 2018 or at least 18 days after the posting of this notice, Mecklenburg County will authorize the Ada Jenkins Family Center to submit a request to the U.S. Housing and Urban Development (HUD) agency for the release of Community Development Block Grant program funds under Title I of the Housing and Community Development Act of 1974 (PL 93-383), to undertake a project known as Ada Jenkins Facility HVAC Energy Efficiency Improvement Project for the purpose of replacing all of the facilities heating and cooling systems with a centralized HVAC system to will allow for creating energy efficiencies within the community center. The project is located at 212 Gamble Street, Davidson, NC 28036.

FINDING OF NO SIGNIFICANT IMPACT
The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. Mecklenburg County has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act (NEPA) is not required. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file the ERR can be examined upon requests. PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to Victoria Avramović, Centralina Council of Governments, 9815 David Taylor Drive, Charlotte, NC 28262 or cedc@centralina.org. All comments received by March 2, 2018 will be considered by Mecklenburg County prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
ENVIRONMENTAL CERTIFICATION
Mecklenburg County certifies to the HUD/Greensboro field office that Dena Diorio in her capacity as County Manager consents to accept the jurisdiction of the courts if an action is brought to enforce responsibilities in relation to the environmental review process and that responsibilities have been satisfied. The HUD/Greensboro Field Office’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows Mecklenburg County to use program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD/Greensboro Office will accept objections to its release of funds and the RE’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases:
- The Certification was not executed by the Certifying Officer of Mecklenburg County;
- Mecklenburg County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58;
- The grant recipient or other participants in the development process has committed funds, incurred costs, or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the HUD Greensboro Office; or
- Another federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to:
